THE DOCUMENTS WE PREPARE:
STIPULATION OF SETTLEMENT: In cases where the Plaintiff and Defendant have marital property, marital debts, spousal maintenance, and or unemancipated children of the marriage, we prepare a comprehensive and detailed Stipulation of Settlement for the parties to sign. The Stipulation of Settlement that Pacific Typing Corporation utilizes was originally prepared by an attorney and has been constantly updated based on feedback we have received from attorneys and the courts. Our Stipulation of Settlement has also been customized over the years to conform with the unique requirements of the New York State Supreme Court on a county by county basis to facilitate the resolution of a NY uncontested divorce. Our Stipulation of Settlement is accepted in all New York Counties, and is successfully incorporated but not merged in all the UD-11 Judgment of Divorce forms we prepare for our clients. We recently revised our Stipulation of Settlement due to the increases required by New York State statute in the combined parental income child support cap, which is based on the consumer price index for all urban consumers (CPI-U) published by the US Department of Labor. The old caps were $130,000, and then $136,000 effective January 31, 2012, and then $141,000 effective January 31, 2014, and then $143,000 effective March 01, 2016, $148,000 effective March 01, 2018, $154,000 effective March 01, 2020, $163,000 effective March 01, 2022, and $183,000 effective March 01, 2024. The statute requires adjustment of the cap on March 01 every other year. We also revised our Stipulation of Settlement to conform with the new $228,000 maintenance income cap effective March 01, 2024. The CSSA Low Income Exemption numbers and calculations were also changed on March 01, 2024. We have extensive experience in successfully handling cases where the CSSA Low Income Exemptions apply.
UD-1 SUMMONS WITH NOTICE: We have customized our UD-1 Summons With Notice to include the required DRL §236 & DRL §255 Notices, as well as the new Notice of Guideline Maintenance. Our Summons With Notice also includes references to marital property, marital debt, equitable distribution, child custody, child visitation, child support pursuant to the CSSA, and spousal maintenance, as needed.
UD-2 VERIFIED COMPLAINT: We have formatted our UD-2 Verified Complaint to conform with the requirements of the New York State Supreme Courts in all counties. Our UD-2 Verified Complaint references marital property, marital debt, equitable distribution, child custody, child visitation, child support pursuant to the CSSA, and spousal maintenance, as needed.
UD-3 AFFIRMATION OF SERVICE: Our UD-3 Affidavit of Service is customized based on the needs and circumstances of the client and Defendant.
UD-4 SWORN STATEMENT OF REMOVAL OF BARRIERS TO REMARRIAGE: Our UD-4 Removal of Barriers is only required in default cases. The rest of our forms have been designed so that the Defendant waives the need for the UD-4 Removal of Barriers when they sign our UD-7 Affirmation of Defendant. All other documents accurately reflect the Defendant’s waiver if the Defendant signs the UD-7 Affirmation of Defendant.
UD-5 AFFIRMATION OF REGULARITY: The UD-5 Affirmation of Regularity form is based on the one available from the New York State Unified Court System and is customized on a case by case basis to meet the needs of our clients.
UD-6 SWORN AFFIRMATION OF PLAINTIFF: The UD-6 Sworn Affirmation of Plaintiff form we use is based on the one available from the New York State Unified Court System’s website. Each UD-6 Sworn Affirmation of Plaintiff document we prepare is customized and tailored to meet the specific facts and circumstances of our clients and customers.
UD-7 AFFIRMATION OF DEFENDANT: Pacific Typing Corporation’s UD-7 Affirmation of Defendant is also based on the one available from the New York State Unified Court System’s website. It is customized to include the Defendant’s waiver of the need for the UD-4 Removal of Barriers if applicable. It also includes all the necessary acknowledgments and waivers required to proceed with an uncontested divorce in New York.
UD-8(1) ANNUAL INCOME WORKSHEET: This is a new form introduced with the new maintenance law. We will prepare this worksheet fully completed with all necessary mathematical computations for all cases.
UD-8(2) MAINTENANCE GUIDELINES WORKSHEET: This is a new form introduced with the new maintenance law. We prepare this worksheet fully completed with all necessary mathematical computations for all cases. This form was updated in March 2017, and again in March 2018. The old maintenance cap was $192,000 effective March 01, 2020, $203,000 effective March 01, 2022 and the new maintenance cap is $228,000 effective March 01, 2024. This form was updated on March 01, 2024 due to the court's March 01, 2024 changes in the poverty level and changes in the self support reserve.
UD-8(3) CHILD SUPPORT WORKSHEET: Our UD-8(3) Child Support Worksheet is based on the one available from the New York State Unified Court System’s website. We have customized ours to automatically do the New York State child support calculations and NYS CSSA child support guidelines calculations so that there are never any math errors. We have customized the UD-8(3) Child Support Worksheet available from the New York State Unified Court System’s website to include a computerized spreadsheet to eliminate the possibility of mathematical errors. We recently revised our Child Support Worksheet - Form UD-8(3) due to the new maintenance law, and because of increases required by statute in the combined parental income child support cap, based upon the consumer price index for all urban consumers (CPI-U) published by the United States Department of Labor. The old caps were $130,000, $136,000, $141,000, $143,000, $148,000, $154,000, $163,000, and now $183,000 effective March 01, 2024. The statute requires adjustment of the cap on March 01 every other year. We updated our form on March 01, 2024 to conform with the new income cap. This form was updated by the court on March 01, 2024 due to the March 01, 2024 changes in the poverty level and changes in the self support reserve.
UD-8A SCU INFORMATION SHEET: The following documents and divorce forms we use are taken directly from the New York State Unified Court System’s website: UD-8a SCU Information Sheet (Support Collection Unit), RJI Addendum (UCS-840M) (Request for Judicial Intervention), NYS Case Registry Filing Form, and the UCS-111 Child Support Summary Form.
UD-9 NOTE OF ISSUE: Our UD-9 Note of Issue form is derived from the New York State Unified Court System’s website and is individualized for each customer and client as needed.
UD-10 FINDINGS OF FACT AND CONCLUSIONS OF LAW: We spend a great deal of time preparing the UD-10 Findings of Fact form which is required in all NY uncontested divorce cases. Our UD-10 Findings of Fact document is hand prepared to address all of the factual issues present in our client’s cases. In this form, we address such issues as residency, military service, children of the marriage, grounds for divorce, type of marriage, maintenance, child custody and visitation, Equitable Distribution pursuant to DRL §236(B)(5), child support pursuant to the CSSA, health insurance for the children, and all other required affirmations and notifications. We recently revised our Findings of Fact and Conclusions of Law (Form UD-10) because of increases required by statute in the combined parental income child support cap, based upon the consumer price index for all urban consumers (CPI-U) published by the United States Department of Labor. UD-11 JUDGMENT OF DIVORCE: for both waiver and default cases. Our UD-11 Judgment of Divorce includes the grounds for divorce, custody of minor children, visitation with minor children, child support, spousal maintenance, child support add-ons, Equitable Distribution pursuant to DRL §236(B)(5), and all other required information.
UD-12 PART 130 CERTIFICATION: Our UD-12 Part 130 Certification is closely based on the one available from the New York State Unified Court System’s website.
UD-13 RJI REQUEST FOR JUDICIAL INTERVENTION: Our UD-13 RJI (Request for Judicial Intervention) is based exactly on the one available from the New York State Unified Court System’s website, and each one is customized with all of our client’s needed information.
UCS-840 RJI REQUEST FOR JUDICIAL INTERVENTION: In addition to preparing the UD-13 RJI (Request for Judicial Intervention), we also prepare the UCS-840 RJI (Request for Judicial Intervention). Depending on the County, we have been finding that some clerks want the UD-13, other clerks want the UCS-840, and some want both. So, we prepare both Request for Judicial Intervention forms just to be absolutely sure that you can satisfy any clerk in any County.
UD-14 NOTICE OF ENTRY: Our UD-14 Notice of Entry is closely based on the one available from the New York State Unified Court System’s website.
DOH-2168 CERTIFICATE OF DISSOLUTION: The DOH-2168 Certificate of Dissolution we utilize is based exactly on the one available from the New York State Unified Court System’s website, and each one is customized with all of our client’s needed information.
HOW THE NEW YORK DIVORCE STARTS:
a. Prepare an original and two copies of the Summons With Notice, the Notice of Automatic Orders, the Notice of Guideline Maintenance, and the Notice Concerning Continuation of Health Care Coverage; and
b. Purchase an index number at the County Clerk's Office and file the original of the Summons With Notice, the Notice of Automatic Orders, the Notice of Guideline Maintenance, and the Notice Concerning Continuation of Health Care Coverage with the County Clerk. You will be required to pay $210 for the index number. Check with the County Clerk regarding acceptable forms of payment. Many County Clerks also will require that you fill out an Index Number Application Form which we provide.
c. Put the index number and the date of the filing on the two copies of the Summons With Notice, the Notice of Automatic Orders, the Notice of Guideline Maintenance, and the Notice Concerning Continuation of Health Care Coverage if this is not done by a clerk upon filing the papers.
d. Defendant signs Affirmation of Defendant and Stipulation of Settlement. If the Defendant will not cooperate, then you must have the Defendant served with one copy of the Summons With Notice, and the Notice of Automatic Orders, the Notice of Guideline Maintenance, and the Notice Concerning Continuation of Health Care Coverage, by being personally handed the papers. Service upon the Defendant of the Summons With Notice, the Notice of Automatic Orders, the Notice of Guideline Maintenance, and the Notice Concerning Continuation of Health Care Coverage must be made within 120 days of their filing with the County Clerk's Office. If you do not know where the Defendant is located, you may wish to delay filing the Summons With Notice until he or she is located, so that the 120-day period does not begin running while you search for your spouse.
If the Defendant will not cooperate and if the Defendant must be served, the person that served the Defendant must prepare an "Affirmation of Service", which attests to the service of the Summons With Notice, the Notice of Automatic Orders, the Notice of Guideline Maintenance, and the Notice Concerning Continuation of Health Care Coverage. The Affirmation of Service must be completely filled out by the person that served the Defendant. This Affirmation must be submitted along with the full set of divorce papers when you place your case on the court's calendar. There is a 40-day waiting period from date of service to place the matter on the court's calendar. If the Defendant does not cooperate, you must wait the full 40 days before you can file your divorce papers for the Court’s consideration.
HOW THE NEW YORK DIVORCE ENDS:
Once the judge signs the Judgment of Divorce, the parties are legally divorced. The Judgment of divorce ALWAYS states the following:
ORDERED AND ADJUDGED that the Defendant shall be served a copy of the judgment with notice of entry, by the Plaintiff, within 20 days of entry
Included in the divorce finals we prepare are:
(1) Notice of Entry; and
(2) Affirmation of Service by Mail of Judgment of Divorce With Notice of Entry
After the Judge signs the Judgment, all the originals are mailed/sent back to you.
*** NOTE ***
Check the signed judgment. Sometimes, the judge will alter the amount of time that the Defendant must be served a copy of the judgment!
Once all the originals are back from the court:
(1) Make 2 copies of the Judgment of Divorce.
(2) File ALL the originals with the county clerk.
(3) Have the county clerk make 1 certified copy of the judgment and 1 time/date stamped copy of the judgment of divorce.
(4) Keep the certified copy of the divorce for your records - this officially proves the parties are divorced.
(5) Fill out the Notice of Entry (date judge signed judgment + date originals were filed with the county clerk [that is the date entered]), and make a copy of the Notice of Entry. The dates should be first: the date docs are filed, second: the date Judgement of Divorce is mailed to defendant.
(6) Mail the copy of the Notice of Entry + a copy of the date/time stamped copy of the Judgment of Divorce to the Defendant.
(7) Fill out the Affirmation of Service by Mail of Judgment of Divorce With Notice of Entry.
(8) File the ORIGINAL Affirmation of Service by Mail of Judgment of Divorce With Notice of Entry + ORIGINAL Notice of Entry + a copy of the date/time stamped Judgment of Divorce with the County Clerk.
*** NOTE ***
Check with the county clerk in your county and ask the clerk what their preferred procedure is. It may vary slightly. You also might find out that the above is too much in your county. This procedure can vary from county to county.
The above instructions are the most comprehensive we are aware of and should satisfy the requirements in all counties.
